UAE’s Golden Visa Marketing & Caveat Emptor, a Latin Phrase, that means “Let The Buyer Beware”

Malayalam movie actors Mammootty and Mohanlal have received the UAE’s golden visa recently. They both thanked Lulu Group MD, Yusuffali MA, a prominent UAE lobbyist, for his efforts in facilitating the honour.
The principle of ‘caveat emptor’ is not designed to shield sellers, agents, brokers or influencers, who engage in ‘Fraud or Bad Faith’ dealing by making ‘False or Misleading Representations’ about the quality or condition of a particular product.
The phrase also explains that the seller has more information than the buyer about the quality of the product who deliberately cause the buyer to believe something that is not true, especially for personal gain.
When a sale is subject to this warning the purchaser must examine, judge, and test a product considered for purchase himself or herself. The doctrine of caveat emptor explains all sales are final and nothing is guaranteed.
What Is The Golden Visa?
The ‘golden visa’ was introduced by the UAE government in 2019 as a new system for up to 10 years of residence visas for investors. It allows international investors to live, work and study in the emirate without the need of a national sponsor and with 100 per cent ownership of their business on the UAE mainland. There are two types of golden visas available to investors. Investor visa will be issued for those who invest in non-real estate projects and companies in Abu Dhabi and for those who invest in real estate in Abu Dhabi. Each category within the ‘golden visa thrive in Abu Dhabi programme’ has its own set of criteria for the 5-10-year visa options.
Who Is Eligible For Golden Visa?
Investors, for the 10-year visa a minimum of AED 10 million, which is around Rs 20 crore, public investment is required, entrepreneurs, specialised talents and researchers in various fields of science are eligible. The golden visa is also open to talented creative and sporting individuals, start-ups, and real estate investors in the emirate. It can also be extended to include the spouse, children, parents and dependent siblings, among others. Investors for those who invest in real estate in Abu Dhabi worth not less than AED 5 million, entrepreneurs with an existing project with a minimum capital of AED 500,000 and students can apply for 5 years residence visas.

UAE is attributed to an authoritarian regime with blood-stained hands, lacks accountability and total lack of judicial independence. Jailing critics and spying on their citizens and other nations. Anyone who dares to criticize the ruling regime risk arrest, torture, arbitrary detentions and enforced disappearance.
Many activists and dissidents remain detained simply for exercising their rights to free expression and association. Robert Worth’s cover story about a year ago for the New York Times Magazine, “Mohammed bin Zayed’s Dark Vision of the Middle East’s Future,” offers some of the raw material needed to answer the question posed above.
Prisons across the UAE hold detainees in dismal and unhygienic conditions, where overcrowding and lack of adequate medical care are widespread. The UAE continues to block representatives of international human rights organizations and UN experts from conducting in-country research and visiting prisons and detention facilities. In an interview to the New York Times about two years ago, Bruce Riedel, a senior fellow of the Brookings Institution and a former Central Intelligence Agency (CIA) official, said “Mohamed bin Zayed (MbZ, as he is colloquially known) thinks he is Machiavelli but he acts more like Mussolini.”
According to Forbes’ report, Mohamed bin Zayed has used his country’s military and financial resources to thwart the emergence of democratic tendencies in the region, all under the guise of fighting Islamic extremism. A French rights group has sued Abu Dhabi Crown Prince Mohammed bin Zayed in 2018 for his alleged involvement in the war in Yemen which has carried out scores of unlawful attacks that killed more than 100,000 people, some likely war crimes.
The Army in question was trained by the notorious security company once known as ‘BlackWater’, and recruited foreign mercenaries, originally intended to silence the pro-democratic activists inside and outside the country. The UAE and its army both have proved by meddling its neighbouring countries that the victory of the people against any repressive regime in the Arab world is more dangerous than defeat!. ‘Jabir Vs UAE’, The Enforcement Of Judicial Awards.
The case “Jabir Vs UAE” linked with the subject has great relevance. This case of ‘Non-enforcement of a set of UAE Court-Judgments, the guilty of contempt of Courts, the embezzlement of huge funds, Police-looting, extortion [Link], defrauding and other heinous offences pending before the Government of India [Link] and the UAE administration [Link] itself for over a quarter of a century, is just the tip of the ‘UAE Human Rights Violations’ Iceberg! Jabir’s opponents were not ordinary criminals, they were the custodians of Law and the de facto ruler of Abu Dhabi, United Arab Emirates. Despite honouring its moral obligations and assigned responsibilities, the UAE Administration served an arrogant, despotic order of deportation to save face. There cannot be any doubt or dispute about the averments of the ‘Judgment Creditor’, all the claims he had made, as they are fully supported by the orders of Courts both the countries and the official documents of the governments of India and UAE.
The enforcement of a Judgment is regarded as an integral part of the fundamental Human Right to a fair trial in a reasonable time. That has been violated. Worst still, the debtor, the UAE ruler, bypassed all the laws to commit the offence of defrauding the Judgment Creditor in the cruellest and diabolical manner, by deporting him from UAE, thus to deny him the fruits of the decrees obtained by him, forced him to leave behind his well established three business concerns [Link], real estate properties and other investments, images and reputation in the UAE, hard-earned by his blood and sweat and valuable expertise in the profession.
The illegal deportation of an established investor from the country caused a situation associated with great pain, loss of dignity, loss of his entire business institutions etc. Flouting the orders of a judicial body is totally destructive of the ‘Rules of Law’ and Norms internationally upheld for safeguarding ‘Human Rights’; defrauding the Judgment Creditor is a personal and vindictive action and thus the Executive of the State was committed the most heinous, bizarre, and unspeakable crime.
The Judgment Creditor is legally entitled to his business assets, real estate investments left behind in the UAE, when he was fraudulently deported, and the business profits and gains and its market value he would have earned, as well as other expenses for all these years [Link to full text] that followed. Malayalam movie actors Mohanlal and Mammootty received UAE’s ‘Golden Visa’.
The United Arab Emirates (UAE) has granted the much-coveted UAE “golden visa” to Malayalam film actors Mammootty and Mohanlal. Both actors thanked the UAE government for the recognition and also extended their thanks to Lulu chairman Yusuffali MA, a prominent UAE lobbyist, for facilitating the honour.
Yusuff Ali M. A. was appointed vice-chairman of the ADCCI, the top govt business body in Abu Dhabi, United Arab Emirates.

Sheikh Mohamed Bin Zayed Al Nahyan, the crown prince of Abu Dhabi has appointed prominent Indian businessman Yusuffali M.A. as the vice-chairman of the apex government body for all businesses operating from Abu Dhabi, the UAE’s capital city, making him the only person from India on the 29-member board, which is primarily made up of Emirati business owners and CEOs.
ADCCI is the apex govt. body of all business established in Abu Dhabi and functions as an effective bridge between the Govt and business sector. Each of the business establishments in Abu Dhabi, one of the wealthiest and most influential economic hubs in the region, has to be licensed by ADCCI.
Commenting on the appointment Yusuffali said “truly a very humbling and proud moment in my life. My sincere gratitude to the visionary leadership of this great country and I will strive to do my best towards justifying the great responsibility entrusted upon me. Apart from working for the growth of Abu Dhabi economy & the larger business community, I will sincerely work towards further boosting the Indo-UAE trade relations”.

The political substantiation of this thesis is found on excellent grounds well presented in the great book compiled by Sri. P.K.Jabir is a public activist and writer of unitive conviction. The content of this book I am sure would serve the purpose of strongly persuading the Government of India to frame necessary laws empowering Indian citizens living in Gulf Countries to invoke various remedies for the losses and sufferings caused on account of various unforeseen reasons as provided by the United Nations under the rules and regulations framed by it as detailed in the various chapters of the book.
[When the grievances were placed before Justice V.R. Krishna Iyer, he was, despite his many critical disabilities, generous enough to give useful directions. The representation, ‘Indo-Gulf Reparation Mechanisms’ was prepared in the light of the guidelines suggested by him].

Mr.Jabir is a founder member of Niyama Sameeksha, a popular Law Journal which had contributed significantly to legal education for the common man. He continues to be an effective social activist, even while efficiently operating in his professional operations. Mr.Jabir had passed through fire, after his most atrocious deportation from U.A.E., in 1996. As a counsel for Jabir, I had endeavoured much in the Supreme Court and Delhi High Court to secure justice for him. It is sad but true that justice has eluded him so far.
